The government has created Chapter 13 of the Bankruptcy Code as a structured repayment plan that allows you to gradually pay all or some of your debts back over a period of three to five years. Your payment amount is tied to your ability to pay. At the end of the repayment period, most or all of your debt is discharged.
Chapter 13 bankruptcy offers you a way to stop foreclosure of your home and repossession of your car. If you're late on making your mortgage or loan payments, this is a way to pay the arrears back. Typically, the arrears are included in the total repayment amount.
