Chapter 7 bankruptcy, also known as liquidation, allows you to eliminate most or all of your debt, including credit card balances and medical debt. If you qualify, you may able to keep your home if you can make the payments. Generally, your car and retirement plans, along with other assets, are protected. Moreover, Chapter 7 offers debtors immediate relief: Under the law, lawsuits, garnishments and all creditor harassment must stop upon the filing of your case.

What Can You Expect from Me?

When you contact me, you will work directly with an experienced McKinney bankruptcy lawyer who will help you find effective and affordable debt solutions. For about seven years, I have helped men and women get the fresh start they need, and I can help you too.

I will personally handle every aspect of your case, from start to finish. You will never be passed off to a paralegal or office assistant. When you come to me:

  • We will discuss your financial situation.
  • I will gather necessary information about your creditors, assets and debts.
  • I will analyze your assets and whether you can keep them.
  • I will analyze your debts and whether they can be discharged.
  • I will analyze the type of bankruptcy for which you qualify - Chapter 7 or Chapter 13 - and I will explain the pros and cons of each.

Some people have the mistaken belief that their income level disqualifies them from Chapter 7. I will conduct a means test analysis, and if you pass, you can still qualify for Chapter 7 bankruptcy.

What Happens If I Qualify?

If you qualify for Chapter 7 bankruptcy, I will file your case with the Bankruptcy Court. As soon as I file, an automatic stay goes into effect. This legal term means that all collections activity must stop, including lawsuits, garnishment, creditor calls and letters.

About sixty days later, you and I will attend a meeting of creditors. This informal meeting allows creditors to ask you questions. However, many creditors often do not even attend! And remember, I will be there with you, every step of the way.

After that meeting, the court may issue an order discharging or eliminating your debt. The entire process generally takes about six months. It is important to note that certain debts cannot be discharged, like student loans and child support.
