Reorganizing Your Debt

Also called "reorganization," Chapter 13 bankruptcy is basically a structured repayment plan that allows you to gradually pay all or some of your debts back over a period of three to five years. Your payment amount is tied to your ability to pay. At the end of the repayment period, most or all of your debt is discharged.

Chapter 13 bankruptcy offers you a way to stop foreclosure of your home and repossession of your car. As with Chapter 7, as soon as I file your petition with the court, all creditor collection activity must stop, including lawsuits, garnishments and harassing calls or letters.

Why Chapter 13 and Not Chapter 7 Bankruptcy?

People who file for Chapter 13 bankruptcy are usually unable to qualify for Chapter 7 bankruptcy because of their income or asset level, or because they have filed for Chapter 7 within the last several years. Chapter 13 offers individuals effective debt relief and the breathing room they need to catch up on their financial obligations.

What to Expect

When you meet with me, we will discuss and evaluate your financial situation and determine your best options under the law. I will help you understand the requirements of Chapter 13 bankruptcy and take the time to answer any questions you have.

I will file all the necessary paperwork to initiate the Chapter 13 process. As soon as I file your case, an automatic stay will apply, meaning that all creditor harassment must stop. We will work together to develop a confirmation plan and submit a proposed repayment schedule to the court and creditors. As soon as they approve the plan, it takes full effect. This whole process takes about nine months. After you have made all plan payments within the three to five year period, your case is discharged.
