Filing for Bankruptcy: Chapter 7 and Chapter 13

If you are facing overwhelming debt, you may be worried about making your rent or mortgage payments, and keeping up with credit card bills has become impossible. By filing for bankruptcy, we may be able to stop foreclosures, repossessions, lawsuits and wage garnishments. We may be able to keep your car, home and other assets. Also, some or all of your debts from credit cards, lawsuit judgments and medical bills may be eliminated.

There are ways to stop creditor harassment and get a fresh start.

For many years, I have helped men and women understand their rights and options under Chapter 7 and Chapter 13 bankruptcy:

  • Chapter 7 bankruptcy: Chapter 7 bankruptcy is your legal right to a fresh start. If you qualify, Chapter 7 will discharge all or most of your debts.
  • Chapter 13 bankruptcy: Under Chapter 13 bankruptcy, your debts are restructured into an extended payment plan based on your income. This lets you pay all or some of your debts over a three to five year period.

As soon as we file for Chapter 7 or 13 bankruptcy, the law requires that all creditor collection activity must stop. This puts an end to the lawsuits, garnishments and harassing calls and letters.
